AFL-CIO UPHOLDS MM&P’S JURISDICTION OVER LICENSED DECK OFFICER JOBS ABOARD CMA-CGM/APL VESSEL
On Sept. 26, the AFL-CIO disallowed an appeal filed by the Seafarers International Union (SIU) and their affiliate American Maritime Officers (AMO) pertaining to their efforts to crew APL’s newest vessel, the CMA-CGM PHOENIX.
The decision was rendered unanimously by a subcommittee of the AFL-CIO Executive Council after a hearing conducted on Sept. 25.
The subcommittee’s ruling upholds the Aug. 5, 2025, decision of Impartial Umpire Michael Gottesman.
In that decision, Umpire Gottesman ruled that SIU’s affiliate AMO violated the AFL-CIO Constitution by:
— violating Article XX, Section 2, by taking jobs falling under the jurisdiction of MM&P;
— violating Article XX, Section 3, by colluding with an employer (American President Lines) in doing so.
MM&P President Don Josberger renewed MM&P’s demand to SIU and AMO that they comply with their obligations as bona fide trade unions and affiliates of the AFL-CIO.
On Monday, Sept. 29, SIU/AMO confirmed that they will comply with Umpire Gottesman’s ruling.
“This is the third time in ten years that MM&P has had to resort to legal process to protect our job jurisdiction,” Josberger said.
“We are grateful to the AFL-CIO for once again strictly enforcing its Constitution.”
MM&P has represented Licensed Deck Officers aboard APL vessels since the 1930s.

NLRB ISSUES COMPLAINT AGAINST APL FOR VIOLATING ITS LEGAL OBLIGATION TO BARGAIN WITH MM&P
On Sept. 26, Region 21 of the National Labor Relations Board (NLRB) issued a Complaint against American President Lines alleging numerous violations of its obligation to bargain with MM&P.
Among the violations alleged in the Complaint, APL unilaterally implemented policies and installed video cameras beyond those required by the Safer Seas Act without giving the union notice and the opportunity to bargain.
Additionally, APL repeatedly failed to provide and refused to provide information requested by the union which the company was required to provide.
A trial has been scheduled for Feb. 24, 2026.
“For the past two years, APL has shamelessly and repeatedly violated our members’ rights under the law and under our collective bargaining agreement,” said MM&P Pacific Ports Vice President Melany Velleca.
“We will continue to address these violations through arbitration, through litigation in federal agencies and courts, and through any legal means available until APL accepts it must respect its most valuable asset—our members.”
“APL must soon come to the realization that MM&P will not falter in protecting our members’ rights,” said MM&P President Don Josberger.
“In this country, there are consequences for blatantly and dishonorably ignoring the contractual and legal obligations owed to your employees.”

UNIONS CALL FOR PASSAGE OF BILL TO GIVE TRANSPORT WORKERS OVERTIME TAX DEDUCTION
MM&P and other unions are applauding the introduction in Congress of a bipartisan bill that would give a significant tax deduction for qualifying overtime earnings to mariners and other transportation sector workers.
The bill would expand a provision in the recently passed budget reconciliation bill that allows most hourly workers to deduct up to $25,000 in overtime pay from their annual income for tax purposes.
But the tax code uses an outdated definition in the Fair Labor Standards Act that starts overtime at 55 hours of work or more each week, excluding nearly all transportation workers.
Unions are pushing legislators to fix the error so as to expand the benefit.
When the reconciliation bill was debated in Congress in July, Sen. Maria Cantwell (D-Wash.), introduced legislation that would have extended the overtime tax deduction to mariners, aviation workers, rail workers and truckers.
The AFL-CIO Transportation Trades Department reached out to every member of the Senate, urging a YES vote on Cantwell’s amendment, but the Congressional majority decided not to include it in the legislation.
The new bill seeks once again to correct the inequity.
It was introduced by Reps. Nicole Malliotakis (R-N.Y.), Emilia Sykes (D-Ohio), Nick LaLota (R-N.Y.), Steven Horsford (D-Nev.), Brian Fitzpatrick (R-Pa.) and Tom Suozzi (D-N.Y.).
“With this bill, millions of workers, including railroaders, aviation professionals, seafarers, truckers, emergency responders, and delivery workers, would be able to deduct up to $25,000 of qualifying overtime pay from their annual income for tax purposes,” TTD officials said in a statement.
“These workers put in long hours to keep our supply chain moving, support the economy, and serve the public, and deserve a tax deduction for overtime pay above their normal hourly wage, which workers in other industries covered under the Fair Labor Standards Act currently enjoy.”
Unions say that if the bill passes, it could represent as much as $6,000 in annual tax savings for a working family.
MM&P is one of the 39 unions representing millions of transportation workers nationwide who belong to the AFL-CIO Transportation Trades Department.

SECOND OFFICER CHARGED IN UK WITH MANSLAUGHTER IS FOUND GUILTY OF LESSER OFFENSE
The second officer of a British ferry that struck a fishing boat, killing three people, has been found guilty of endangerment rather than manslaughter, the charge levelled by prosecutors.
Under UK law, the crime of endangerment carries a maximum sentence of two years.
The trial stemmed from the December 2022 collision of the ferry COMMODORE GOODWILL with the fishing boat L’ECUME II.
On the morning of the accident, the ferry was traveling at about 19 knots when it struck the fishing boat.
The lookout had left the bridge for breakfast but returned 13 minutes before the accident took place.
Second Officer Lewis Peter Carr, who was also on the bridge, said that at the time of the collision, he had been busy with other duties.
He testified that he believed the collision had taken place because the fishing boat’s lights were off.
Investigators were unable to recover the fishing boat or any of its equipment and so were unable to ascertain whether its lights had been on or off.
If the lights had been on, the court determined, the fishing boat had the right of way, but if they were off, it was the responsibility of its captain to move out of the path of the ferry.
The jury deliberated for 18 hours before finding the lookout not guilty and for another 90 minutes before finding the second officer guilty of endangering ships, structures, or individuals.
The lead investigator in the case commented after the trial that it had been “one of the most complex investigations that the State of Jersey Police had ever handled.”
He said they had taken hundreds of statements, interviewed over 150 witnesses, and examined around 800 documents and over 1000 exhibits.

OFFICIALS IN MIAMI SEIZE COCAINE ATTACHED TO HULL OF FOC SHIP
Customs and Border Patrol agents seized what they called “a parasitic shipment” of cocaine attached to the hull of an Antigua and Barbuda flagged cargo ship that had just arrived in the Port of Miami on Sept. 23.
The containership, the HOHEPLATE, had just entered port when CBP divers dove down to remove the drugs, the agency said in a statement on X.
A CBP official, Michael W. Banks, said the dive team was in the water Tuesday when they discovered a “parasitic load strapped to the hull of a vessel arriving from the Dominican Republic.”
He reported that the divers had used “specialized underwater cutting tools” to detach the packages containing eight pounds of cocaine from the vessel’s hull.
The social media post included photos of multiple divers working at the stern of the cargo ship.
No arrests have been made.
“Our specialized team made history with their first ever parasitic drug seizure,” Banks posted.
“This marks an innovative advancement to continuing narcotics interdiction efforts.”

APPLICATIONS NOW OPEN FOR 2026 UNION PLUS SCHOLARSHIP PROGRAM
Union Plus Scholarships help union families with the cost of college by offering awards ranging from $500 to $4,000.
The application for the 2026 Union Plus Scholarship Program has been posted online.
The deadline to apply is Jan. 31, 2026.
Current and retired members of unions participating in any Union Plus program, their spouses and their dependent children (as defined by IRS regulations) are eligible.
These are one-time cash awards for study beginning in the Fall of 2026. Students may re-apply each year.
The award date is May 31, 2026. During the first week of June 2026, award recipients will be notified by postal mail, and all applicants will be sent email notification.
Awards must be used for the 2026-27 school year.
Since 1991, the Union Plus Scholarship Program has awarded more than $5.9 million to students in over 4,200 union families.
The applicant must be accepted at a US-accredited college, university, community college, technical or trade school at the time awards are issued.
Undergraduate and graduate students are eligible to apply.
