NATIONAL LABOR RELATIONS BOARD BANS CAPTIVE AUDIENCE MEETINGS
The National Labor Relations Board, now with a majority of members appointed by President Biden, has ruled that employers can’t force workers to attend captive audience meetings.
In a 3-1 decision, the Democratic majority of the current NLRB ruled that so-called captive audience meetings violate the law because they tend to “coerce” employees.
The law “does not license employers to compel employees, on pain of discipline or discharge, to attend meetings where they are forced to listen to the employer’s views,” the majority wrote.
The sole Republican member of the Board dissented from the majority opinion.
Captive audience meetings are used to intimidate workers and spread misinformation: employees can be fired for failing to participate in the meetings or for asking questions.
Workers who are forced to attend captive audience meetings may fear that their jobs are at risk if they don’t adopt the employer’s point of view.
The case before the Board involved the first Amazon warehouse to unionize, when the company spent millions of dollars on an anti-union campaign.
The Economic Policy Institute, a think tank affiliated with the AFL-CIO, has reported that 89 percent of all employers conduct captive audience meetings in response to organizing efforts.
“For far too long, managers have been allowed to fearmonger and threaten discipline, site closure, wage and job cuts, deportation, and more if workers form a union,” the AFL-CIO said in a statement issued after the ruling was announced on Nov. 13.
“Finally, with this ruling, workers have a more even playing field.”
“In just a few weeks, there’s no doubt that Donald Trump and his incoming administration will put the NLRB and rulings like this under attack.”
“When they do so, it’s incumbent on our entire labor movement—no matter which side of the aisle you’re on—to stand together for basic fairness.”
More than half dozen states, of which California is the largest, have also banned captive audience meetings.

APL CONTINUES FLEET RENEWAL WITHOUT REGARD TO SAFETY OF LIFE AT SEA
U.S.-government-subsidized American President Lines, a division of France’s CMA-CGM, has flagged another 837-foot, 6552-TEU newbuilt container vessel into the Maritime Security Program.
The MV PRESIDENT MONROE, the fourth of up to seven new ships, was flagged in last week in Los Angeles as part of the company’s fleet renewal program.
It was preceded by the PRESIDENT REAGAN, the PRESIDENT JOHN QUINCY ADAMS, and the PRESIDENT GRANT.
While MM&P salutes new tonnage being brought into the U.S. Merchant Marine, the unsafe way APL is doing so is deplorable.
Notwithstanding a $5.3m-per-vessel annual federal subsidy, APL has chosen to downgrade the safe navigation of its fleet.
While CMA-CGM vessels of similar size and in similar trades flying the flag of France or flag-of-convenience countries—including Malta—typically carry five Licensed Deck Officers, including the Master and a day-working Chief Mate, local U.S. management has made what it calls a “business decision” to eliminate one navigation officer.
The result is that the Chief Mate must stand the missing officer’s navigation watch as well as complete the multitude of standard Chief Mate duties required under the company’s safety management system (SMS).
While the remaining officers struggle to carry out their required duties during permitted hours of work and comply with the company SMS—failure to complete one SMS item may lead to termination—the company has implemented the following “innovative” ways to increase productivity:
— Downgrading its once highly regarded Bridge Team Management system. This system was implemented some twenty years ago after careful analysis of several tragic marine casualties. Fewer Deck Officers will now be on duty during operationally challenging times. Safety is being compromised.
— Chief Mates must attend to their many administrative duties while on navigation watch at sea. Doing so while a vessel is underway is inherently unsafe.
— Chief Mates are advised to conduct their morning maintenance planning meetings with other crew members while on navigation watch at sea.
— Chief Mates are expected to work through their breakfast to complete their duties within the unofficial 90- to 98-hour work week.
— Masters who scrupulously maintain and enforce work/rest requirements or register safety concerns are chastised as being poor managers and are subject to coercive “Performance Improvement Plans.”
— No training provided to Deck Officers for an entirely new Wartsila Bridge Navigation Suite.
— Unceasing revisions of ISM/SMS requirements that are geared to shifting all responsibility from the company to the Master.
APL continues to fail to include 46 CFR Section 8104(a) as part of its SMS. This safety regulation has been a federal requirement for decades.
It requires the following: An owner, charterer, managing operator, master, individual in charge or other person having authority may permit an officer to take charge of the deck watch on a vessel when leaving or immediately after leaving port only if the officer has been off duty for at least 6 hours within the 12 hours immediately before the time of leaving.
These and other unilateral changes to the working conditions, health and safety of MM&P Deck Officers are the subject of Unfair Labor Practice charges filed with Region 21 of the National Labor Relations Board.
Among the eight separate counts of failing to bargain in good faith is “[d]ealing directly with employees regarding work/rest hours, safety, and crewing in derogation of the Union by meeting with groups of employees regarding those topics over the specific objection of the Union and despite demands that the Employer bargain only with the Union on those topics.”
MM&P and affected vessel Masters have also brought this to the attention of the highest level of the U.S. Coast Guard.
We urge every member aboard ship, whether employed at APL or at any other company, to put their health, their safety, their license and their livelihood first.
No job or company faux approval is worth risking any of those.

ST. LAWRENCE SEAWAY GIVES HISTORIC TUG TO GREAT LAKES MARITIME ACADEMY
The Great Lakes Maritime Academy will officially welcome a new towing vessel, the ROBINSON BAY, into its fleet early next year.
The tug is being donated to the school by the Great Lakes St. Lawrence Seaway Development Corporation to be used as a training vessel for deck cadets and, possibly, engine cadets.
GLMA has leased a towing vessel since 2020.
In October, GLMA Superintendent Jerry Achenbach informed the Board of Trustees of the donation, noting that the tug had a historic legacy because its construction in 1958 took place around the same time that other important events occurred in the history of the Lakes.
In late 1957, the Mackinac Bridge was opened to connect the Upper and Lower peninsulas of Michigan.
Planning for the Poe Lock at the Soo began in 1959, the same year that the St. Lawrence Seaway opened.
The ROBINSON BAY was built in the same year as the EDMUND FITZGERALD, the Great Lakes freighter that sank in a storm on Lake Superior on Nov. 10, 1975, taking with it the entire crew of 29.
Four weeks before the decision was made to donate the ROBINSON BAY to GLMA, the school received an email instructing it to put together a proposal explaining how the vessel would be used and ensuring that its heritage would be respected.

“US SHOULD ENCOURAGE AMERICA’S YOUTH TO JOIN THE MERCHANT MARINE”
Unions are calling on Congress to support a provision in national defense legislation that authorizes the Maritime Administration to undertake a marketing plan to encourage young Americans to consider a career in the Merchant Marine.
MM&P and the AFL-CIO Transportation Trades Department are among the labor organizations that have reached out to House and Senate transportation committee leaders to express their support for the establishment of a national marketing campaign to promote the US-flag Merchant Marine.
“Like the military, the US-flag maritime industry faces workforce challenges due to the COVID-19 pandemic and other economic and lifestyle factors,” the unions wrote in an Oct. 31 letter to the heads of the House and Senate Transportation Committees.
“[T]hanks in part to aggressive advertising, the services are all expected to hit their recruitment goals…,” they added.
“But the merchant marine, which Military Sealift Command and US Transportation Command depend on for logistics movements for the Department of Defense, has been unsuccessful in regaining its lost workforce.”
The unions noted that despite its mission as a promotional agency, MARAD has not been funded or staffed to carry out the type of communications campaign necessary to reach the young people of today.
“[N]otwithstanding our own organizations’ efforts to promote the maritime industry and to recruit individuals for employment aboard US-flag vessels,” they added, “it is clear we need a significant, concentrated effort to better educate young people about the many opportunities available in maritime.”
The unions noted that there are several paths open to those interested in becoming merchant mariners:
— enrollment in the United States Merchant Marine Academy or one of the six state maritime academies;
— participation in a Department of Labor-approved apprenticeship course available to anyone who can pass an 8th-grade equivalency exam; or
— through one of the labor-management training institutions that the unions operate in conjunction with US-flag carriers.

49TH EDMUND FITZGERALD MEMORIAL CEREMONY ON YOUTUBE AND FACEBOOK
The Great Lakes Shipwreck Historical Society’s Annual EDMUND FITZGERALD Memorial Ceremony has been posted on https://www.youtube.com/watch?v=WMWc3JGyGuM and Facebook.
When it was launched, the EDMUND FITZGERALD was the largest ship on the Great Lakes.
It carried taconite from mines near Duluth to iron works in Detroit and other Great Lakes ports.
On Nov. 10, 1975, it ran into a severe storm on Lake Superior, with near-hurricane-force winds and waves up to 35 feet high.
It sank suddenly in Canadian waters shortly after 7:10 p.m., taking with it the entire 29-person crew. To this day, the exact cause of the sinking remains unknown.
The Great Lakes Shipwreck Museum has become one of Michigan’s most popular destinations in the cultural tourism industry, attracting nearly 100,000 visitors each season.
It is located near Whitefish Point Light Station, a historic site on the National Register of Historic Places, where visitors can learn about the perils of Great Lakes transport.
The Whitefish Point Light Tower, which has been in continuous operation since 1861, is the oldest operating lighthouse on Lake Superior.
