PRESIDENT BIDEN REESTABLISHES LABOR-MANAGEMENT PARTNERSHIPS AT FEDERAL AGENCIES
President Biden has reestablished labor-management partnerships at federal agencies, underlining his commitment to be the “most pro-union president in American history.”
Labor-management partnerships aim to promote productive working relationships through “forums” that include regularly scheduled meetings of agency officials and union representatives.
Presidents Clinton and Obama established labor-management forums during their administrations, only to see their successors quickly rescind the policies upon taking office.
President Biden’s new executive order ensures that all government agencies will use the policy to improve their employee relations and overall operations.
“Whether serving as a management official with the Navy or a Union official with MM&P, I have always strongly believed that management representatives are not representing their organizations or Commands well if they are not protecting workers’ rights,” says MM&P Federal Employees Membership Group Representative Randi Ciszewski.
“Fortunately, most of our federal employers continue to partner with MM&P through our pre-decisional input resulting in informal, collaborative settlement of most issues.”
“By working with our federal employers interested in fostering positive, productive labor management relationships with the Union, our members benefit by the parties informally resolving concerns.”
The Office of Personnel Management has now issued guidance instructing all agencies to work with unions to create labor forums based on this type of shared vision.
The guidance stipulates that “all the forums should be built on a common understanding of how they will help achieve results for the Agency and its employees.”
Agencies have until Sept. 3 to work with unions to submit their written Labor-Management Forum implementation plans to the Office of Personnel Management.
“This is a great example of the type of leadership we have at Circle Line.”

MV DALI TO BE MOVED FROM BALTIMORE BRIDGE SITE IN COMING DAYS
The organizations overseeing the removal of wreckage at the Baltimore bridge site said that the cargo ship MV DALI is expected to be removed by Friday.
Once the ship is out of the way, a 45-foot-deep channel can be made operational, the Unified Command said in a statement, to allow the transit of deeper draft ships into and out of the port.
The new channel will have a 300-foot horizontal clearance and a vertical clearance of 214 feet.
Vessel transits will be subject to weather conditions, the progress of salvage operations, and the Captain of the Port’s discretion, a Coast Guard spokesperson said.
Last week, more than 180 containers were removed from the DALI, enough to make it possible to proceed with moving the ship.
A 35-foot-deep emergency channel that opened previously has been closed to allow crews space to safely remove it.
Several shallower alternate channels will remain open during the DALI removal process.
Meanwhile, the National Transportation Safety Board said it expects to release its preliminary report on the disaster later this week.
A spokesperson for the Army Corps said that, in accordance with its original timeline, it expects to reopen the main shipping channel—measuring 50 feet deep and 700 feet wide—by the end of the month.
DIVE BOAT CAPTAIN SENTENCED TO FOUR YEARS IN PRISON OVER 2019 FIRE
The captain of a dive boat that caught fire off the California coast in 2019 has been sentenced to four years in prison.
Thirty-four people aboard the boat died when it burned to the waterline and sank.
The captain, Jerry Nehl Boylan of Santa Barbara, was convicted last November of “seaman’s manslaughter,” which is punishable by up to 10 years in federal prison.
Only five crewmembers, including Boylan, survived the blaze.
During the 10-day trial, prosecutors accused him of abandoning ship to save himself instead of rescuing the passengers and one member of the crew who were trapped below deck.
The jury also found him responsible for not having a night watch, insufficient fire drills and crew training, not providing firefighting instructions or using firefighting equipment, not performing any lifesaving or firefighting activities, and not warning passengers and crew about the fire.
Defense lawyers had argued that the vessel’s owner was responsible for not requiring night patrols or fire training.
The National Transportation Safety Board determined that the owner and operator of the dive boat had failed to provide effective oversight of vessel operations and the crew.
The agency also highlighted the absence of smoke detection in accommodation spaces and inadequate emergency escape arrangements as contributing factors to the high loss of life.
The fire began in the back of a middle deck salon where lithium-ion batteries were being charged, according to the NTSB.
But the agency could not say whether it was the lithium-ion batteries, the ship’s electrical system or an unattended fire source that ignited the blaze.
The agency found that the fire had been burning for at least 30 minutes before a member of the crew who was sleeping in the wheelhouse atop the three-deck boat was awakened by a pop, crackle, and the glow of the flames from the middle deck.
In the aftermath of the accident, the NTSB recommended sweeping changes to small vessel oversight by the U.S. Coast Guard, including better smoke detection systems and emergency exits that lead to different areas of the boat.
REUTERS REPORTS THAT IRAN HAS FREED CREW OF SHIP SEIZED LAST MONTH IN STRAIT OF HORMUZ
Reuters reported Monday that Iran has released the crew of a Portuguese-flagged ship, MSC ARIES, which was seized on April 13 by commandos who rappelled onto the deck from a helicopter.
The vessel has a crew of 25. One person, a female cadet, was earlier allowed to disembark and return home to India. All members of the crew are said to be unharmed.
Iran said it had seized the ship in retaliation for an attack by Israel on its consulate in Damascus.
MSC leases the ARIES from Gortal Shipping, an affiliate of Zodiac Maritime, which is partly owned by Israeli businessman Eyal Ofer.
Iran said it plans to retain the ship because it “turned off its radar in Iran’s territorial waters and jeopardized the security of navigation,” making it subject to “judicial detention.”
Iran had come under pressure to release the crew from the vessel’s flag state, Portugal, as well as from India, Pakistan, the Philippines, and Russia, all of which have crewmembers aboard the vessel.

PRESIDENT BIDEN VETOES BILL SEEKING TO OVERTURN NLRB’S JOINT-EMPLOYER RULE
President Biden has vetoed a measure that sought to overturn the National Labor Relations Board rule preventing corporations from hiding behind a subcontractor or staffing agency when workers want to collectively bargain.
The NLRB’s joint-employer rule expands bargaining obligations and liability for labor violations for employers that have power over working conditions, even if workers are hired through a third party or by franchisees of a larger franchise.
The rule ensures that union members can bargain with each company that has the power to make changes in the workplace.
A two-thirds majority in the House and Senate would be required to overturn the veto, an unlikely scenario because an overwhelming majority of congressional Democrats endorse the NLRB’s rule.
“Without the NLRB’s rule, companies could more easily avoid liability simply by manipulating their corporate structure, like hiding behind subcontractors or staffing agencies,” President Biden said.
“If multiple companies control the terms and conditions of employment, then the right to organize is rendered futile whenever workers cannot bargain collectively with each of those employers.”
He said members of Congress who are seeking to overturn the rule “are siding with union-busting corporations over the needs of workers and their unions.”
“Since day one, my Administration has fought to strengthen workers’ right to organize and bargain for higher wages, better benefits, and safer working conditions,” he said.
“The NLRB’s rule would prevent companies from evading their bargaining obligations or liability when they control a worker’s working condition—even if they reserve such control or exercise it indirectly through a subcontractor or other intermediary.”
“I make no apologies for my Administration protecting the right to organize and bargain collectively.”
The NLRB is an independent federal agency that protects employees from unfair labor practices and protects the right of private sector employees to join together, with or without a union, to improve wages, benefits and working conditions.

MILITARY SEALIFT COMMAND CHRISTENS NEWEST CIVMAR-MANNED SHIP
MSC’s newest ship, the expeditionary sea base USNS ROBERT E. SIMANEK, was christened on May 4 at General Dynamics NASSCO in San Diego.
The licensed deck officers aboard the new ship are represented by the MM&P Federal Employees Membership Group.
Captain Bobby Summers, master of the vessel, was among those who attended the christening. He was joined by four Medal of Honor recipients and members of the Simanek family.
Private 1st Class Robert E. Simanek, for whom the vessel is named, was a Marine who was awarded the Medal of Honor for his actions during the Korean War at Outpost Irene, Korea.
During the battle, Simanek threw himself on a grenade, absorbing the explosion with his body and shielding his fellow Marines from serious injury or death.
While he sustained severe injuries to his legs, Simanek survived. He died in 2022 at the age of 92.
USNS ROBERT E. SIMANEK is the seventh ship in the expeditionary mobile base platform built for MSC, and the third expeditionary staging base model.
When activated, it will primarily support aviation mine countermeasure and special operations force missions.
In addition to the flight deck, the ship has a hangar with two aviation operating spots capable of handling MH-53E Sea Dragon-equivalent helicopters; accommodations, workspaces, and ordnance storage; enhanced command, control, communications, computers, and intelligence; and a reconfigurable mission deck area to store equipment including mine sleds and rigid hull inflatable boats.
MSC directs and supports operations for approximately 140 civilian-crewed ships that replenish U.S. Navy ships at sea, conduct specialized missions, preposition combat cargo at sea around the world, perform a variety of support services, and move military equipment and supplies to deployed U.S. forces.

MITAGS-WEST SEEKS FULL-TIME LEAD INSTRUCTOR
MITAGS-West is seeking a full-time lead instructor, responsible for presenting courses and providing quality classroom instruction.
The position entails ensuring that course content is current, consistent with the latest directives from regulatory authorities and best practices in the maritime industry.
The lead instructor shall act as a course content expert and:
— assist in development of curriculum and professional training;
— collaborate with colleagues to ensure courses meet the needs of students and standards set by the USCG, IMO, and or other regulatory authorities;
— participate in professional development, such as conferences and training;
— brief instructors on any changes to the course curriculum or content prior to instructors teaching any course under the lead instructor’s purview;
— give feedback to the department head on the qualifications and effectiveness of instructors teaching courses under the lead instructor’s purview;
— assist the department head and, as appropriate, the assistant academic director in sourcing and recommending qualified instructors.
The lead instructor may be designated to work directly with specific companies for curriculum development or special projects.
Desired qualifications include:
— USCG Officer Level License, with experience sailing under his/her highest-level license and similar experience are a plus—may be substituted with equivalent uniformed service experience (NOAA, USCG, USN);
— if not holding a Chief Mate-Master’s license, working diligently towards that certification;
— degree in Adult Education, Maritime Sciences, or related field desired;
— two years’ experience supervising subordinates in a similar environment desired;
— experience teaching adults professional subjects for minimum of two or more years;
— experience, training, and qualifications required to obtain approval to teach the courses in the field from the U.S. Coast Guard is required;
— excellent computer skills, including MS Office Suite (Word, Excel, PowerPoint) and related information systems;
— demonstrated sound judgment and decision-making skills;
— capable of developing sound, detailed analyses to support actions and/or recommendations;
— strong interpersonal, writing and communication skills required, as well as ability to work effectively with all levels of the organization.
Position may require moderate physical activity, as well as some travel, to MITAGS-East campus or other sites and company locations as directed.
This is a full-time job with full benefits. The starting salary is $90,854.40.
