MM&P CONVENTION WRAP UP / NOMINATIONS FOR ELECTED POSITIONS

The 90th MM&P Regular Convention took place June 24–27 at MITAGS in Linthicum Heights, MD.

Among the guests were MM&P members, national and international labor leaders, and current and former U.S. government officials.

Speakers on the first day of the Regular Convention included:

— former Maritime Administrator RADM Mark Buzby (USN (Ret.);

— Sara Nelson, International President of the Association of Flight Attendants-CWA; and

— ILA International Vice President Ken Riley.

MM&P President Don Marcus and Secretary-Treasurer Don Josberger gave their reports on the second day.

USCG HONORS CHARLESTON HARBOR PILOT FOR HANDLING OF SHIP THAT LOST PROPULSION CONTROL

Charleston Harbor Pilot Christopher Thornton has received the Coast Guard’s Meritorious Public Service Award for his handling of the MSC containership that lost propulsion control on June 5 while traveling outbound from the Port of Charleston.

Thornton safely navigated the ship for more than 20 nautical miles at nearly double its normal speed through several major turns and under the Ravenel Bridge.

The Coast Guard said the pilot’s actions were “nothing short of miraculous.”

Local first responders, alerted by the Charleston Harbor Pilots dispatcher, shut down the bridge for a short time and cleared the shipping channel while the vessel passed.

“Our mission requires us to be prepared for the unexpected, and in this case, our pilot and our staff applied our training and experience to avert a potentially very serious situation that would have impacted the community and the port,” said W. Crayton Walters III, president of the Charleston Branch Pilots Association.

“The quick and astute responses of the Coast Guard, and our local police and fire departments to clear the channels, the beaches, and the bridge ahead of the ship were just as critical to safeguard the public from harm, and we commend each of them for their actions,” he added.

The Meritorious Public Service Award, one of the highest public service awards that the Coast Guard can bestow, recognizes those who have shown unusual courage in advancing a Coast Guard mission or made a substantial contribution that produced tangible results to the public.

MARSHALL ISLANDS-FLAG BULK CARRIER ENCOUNTERS FLOTILLA OF SUSPICIOUS BOATS OFF YEMEN

The master of the Marshall Islands-flag bulk carrier SUMMER LADY reported an encounter with a flotilla of suspicious small craft off the coast of Yemen, including some which could have been waterborne improvised explosive devices.

The encounter took place last week, as the vessel transited 13 nautical miles southwest of Al Mukh, Yemen.

According to the master’s report, the 12 small boats—a mix of fast boats and smaller craft, some of which were uncrewed and resembled kayaks—remained at a distance of 1.2 nautical miles or further for about an hour.

Shortly afterward, U.S. Central Command reported destroying three drone boats in the vicinity.

CENTCOM did not specify whether these unmanned boats were related to the report from the master of the SUMMER LADY, but said they presented an imminent threat to the freedom of navigation.

Another commercial vessel, reportedly the Malta-flag SEAJOY, was hit by one or more Houthi suicide drones in the Red Sea on June 26, about 80 nautical miles southwest of Hodeidah.

The vessel and the crew were not harmed, and the ship continued to its next port of call.

A small craft that at first appeared be a fishing boat struck the bulker TUTOR in the Red Sea on June 12, killing one crewmember and flooding the engine room.

The crew abandoned the ship and the Houthis attacked it again, causing it to sink.

AFTER MULTIYEAR BATTLE, ILA AND PORT OF CHARLESTON NEGOTIATE PLAN TO SHARE CRANE OPERATIONS

In the latest chapter of the long-running battle over the staffing of crane operations at the Port of Charleston, the International Longshoremen’s Association and SC Ports have announced an agreement under which ILA members and port employees will share the work going forward.

“SC Ports and ILA proudly announce that after productive and collaborative conversations, we have mutually developed and agreed to the framework for an operating agreement that will create long-term stability and competitiveness for the Port of Charleston while providing an enhanced product,” the ILA and SC Ports said in a joint statement.

“All obstacles to operations have been removed.”

Previously SC Ports, a state agency, employed port workers, not union members, to operate cranes and heavy-lift equipment.

A 2012 change to the contract specified that future ports would be entirely staffed by ILA members, but SC Ports tried to implement the old system at the new Leatherman Terminal, which was completed early in 2021.

Most major carriers refused to transfer their operations to the Leatherman Terminal because of the dispute that ensued.

The new terminal remained largely inactive while the battle played out in court, until the U.S. Supreme Court refused to take up the case earlier this year, leaving a lower court’s ruling in place.

So, the ILA and SC Ports returned to the bargaining table.

Under their new agreement, crane and equipment operators are free to join the union or remain part of the SC Ports workforce and both will staff the operations.

While the court decision only covered Leatherman, the agreement also includes the older Wando Welch Terminal as well as the smaller North Charleston Terminal, with the new shared model to be applied at all three container facilities.

LAST YEAR, CEO PAY INCREASED BY 13 PERCENT—WORKERS’ PAY ROSE BY JUST 4 PERCENT

A new report published by The Associated Press showed that in 2023, the median compensation package of CEOs of S&P 500 companies was $16.3 million, a 13 percent increase over the previous year.

In contrast, the wages and benefits of private sector workers at the same companies rose by just 4.1 percent. When adjusted for inflation, the “increase” was actually -1.6 percent.

Another data point: at half the corporations surveyed, it would have taken a worker at the middle of the company’s pay scale almost 200 years to make the equivalent of what the CEO takes home in a single year.

That number was up from 185 years in the previous year’s survey.

The AFL-CIO’s annual Executive Paywatch summary came to similar conclusions, finding that while CEO pay remains sky-high, after adjusting for inflation, U.S. workers’ real hourly wages actually fell in 2022 and 2023.

MERCHANT MARINER MEDICAL CERTIFICATE APPLICATION BACKLOG

The National Maritime Center reports that it is experiencing a backlog of medical certificate applications.

It advises mariners to submit their applications 90 days in advance of the expiration date of their current medical certificate.

The NMC says that processing times are now close to 30 days for COMPLETE applications but may be longer for incomplete applications.

The agency says that processing times have increased because of the large volume of e-mails that it receives.

It warns that sending multiple e-mails for individual pages of an application or sending the same information multiple times causes delays in processing for other mariners and will significantly delay the processing of your information.

For example, during the week of June 10-14, 2024, approximately 25 percent of all e-mails processed were duplicate medical certificate applications (CG-719K).

The NMC asks applicants to help improve processing times by adhering to the following guidelines:

— Review your application to ensure it is COMPLETE prior to submission.

— Please review our website to avoid common medical certificate application errors.

— Check your medical certificate expiration date and apply 90 days before it expires.

— E-mail medical certificate applications (CG-719K or K/E) directly to MEDAIP@uscg.mil.

(Other submission options include sending to a REC, fax or U.S. mail, but these options are not processed as quickly as direct submission to MEDAIP@uscg.mil.)

— Enter the e-mail subject line in the following format: LAST NAME_FIRST NAME_MARINER REFERENCE NUMBER.

— Name your PDF file in the following format: LAST NAME_FIRST NAME_REFERENCE NUMBER.

— Medical certificate applications (CG-719K) should be submitted as one PDF.

JPEG and other formats are not accepted.

— Do not send drug test results with your medical certificate applications (CG-719K). Drug testing results should be sent with your MMC application to MMCApplications@uscg.mil.

— If necessary, e-mail medical-related documentation other than medical certificate applications (i.e., additional information) to NMCMedicalClerks@uscg.mil.

As a reminder, only COMPLETE medical applications are accepted for processing.

Incomplete applications are returned to the mariner for correction and must be resubmitted, which delays the processing of the medical certificate application.

COAST GUARD WILL USE STRONGER STOCK ON MMCS ISSUED AFTER JULY 8

The Coast Guard began issuing Merchant Mariner Credentials in a new single-sheet format on March 1.

The new mariner credential replaced the legacy passport-style red book and associated endorsement labels.

The agency says that based on processing observations and customer feedback, the stock used for the new MMC is being upgraded to one that is significantly more tear resistant.

All other appearance and security features remain the same.

The new MMC remains formatted on 8.5” x 11” waterproof and tear-resistant synthetic stock and is far more durable than the previous paper licenses or passport-style books issued in years past.

The updated MMC document will be issued for all approved applications, to include credential endorsements, beginning July 8.

To validate a new MMC, use the Coast Guard’s credential verification tool at MMLD Credential Verification (uscg.mil).

For a document search, select “MMC” as the document type and enter the document number.

On the new MMC, the document number can be found on the red cover section beneath the corresponding barcode and will have the prefix “Z”.

EEOC RELEASES WORKPLACE GUIDANCE TO PREVENT HARASSMENT

The Equal Employment Opportunity Commission has published final guidance on harassment in the workplace.

The document, Enforcement Guidance on Harassment in the Workplace, will help employers create respectful workplaces by providing information on legal standards and employer liability applicable to harassment claims under the federal employment discrimination laws enforced by the EEOC.

The laws protect covered employees from harassment based on race, color, religion, sex (including pregnancy, childbirth or related medical conditions; sexual orientation; and gender identity), national origin, disability, age (40 or older) or genetic information.

Since the Commission last issued guidance on workplace harassment, notable changes in the law have occurred, and new issues—such as online harassment—have emerged.

The new guidance updates, consolidates, and replaces the agency’s five guidance documents issued between 1987 and 1999, and serves as a single, unified agency resource on EEOC-enforced workplace harassment law.

It reflects the Commission’s consideration of the robust public input that it received after the guidance was posted for public comment in fall 2023.

“The updated guidance is a comprehensive resource that brings together best practices for preventing and remedying harassment and clarifies recent developments in the law,” said EEOC Chair Charlotte A. Burrows.

“It incorporates public input from stakeholders across the country, is aligned with our Strategic Enforcement Plan, and will help ensure that individuals understand their workplace rights and responsibilities.”

Between fiscal years 2016 and 2023, more than a third of all discrimination charges received by the EEOC included an allegation of harassment based on race, sex, disability, or another characteristic covered by the laws enforced by the agency.

The guidance includes over 70 examples illustrating unlawful harassment, including situations involving older workers, immigrant workers, and survivors of gender-based violence.

In addition, it illustrates how employees may be subjected to unlawful harassment not only by coworkers or supervisors, but also by customers, contractors, and other third parties.
