Sen. John McCain (R-Ariz.) has once again introduced legislation that would repeal the Jones Act.

The Jones Act is the body of law that protects the jobs of all American mariners, including every member of Masters, Mates & Pilots, by requiring that all goods shipped between waterborne ports of the United States be carried on vessels built in the United States and owned and operated by American citizens.

McCain has long fought for the repeal of the Jones Act, which he calls “burdensome.”

He advocates opening up the U.S. coastwise trades to foreign carriers, despite the economic harm this would do to the American maritime industry and the risks to domestic security.

If passed, his “Open America’s Waters Act of 2017” would decimate the U.S.-flag fleet, sounding the death knell for hundreds of thousands of American jobs in shipbuilding and supporting industries.

It would also weaken U.S. military ship construction and repair capabilities.

America’s domestic maritime industry, which is supported by the Jones Act, is responsible for approximately 500,000 jobs.

The annual economic impact of Jones Act related industries totals nearly $100 billion.

Importantly, U.S. military strategy relies on the availability of U.S.-flag ships and crews and a shipyard industrial base, none of which would exist if the Jones Act were to be eliminated.

The GRETCHEN DUNLAP, operated by Dunlap Towing, helped tow a disabled Maersk containership to safety on Saturday after it lost power and risked running aground in Alaska.

The mariners aboard the GRETCHEN DUNLAP are members of the MM&P United Inland Group-Pacific Maritime Region and the Inland Boatmen’s Union of the Pacific (IBU).

The 872-foot LAURA MAERSK lost power on Friday at around 1700 local time while underway north of Akutan Island in Alaska’s Aleutian island chain.

The vessel was carrying an unconfirmed number of containers and an estimated 51,500 gallons of fURL oil.

A situation report from the Alaska Department of Environmental Conservation (DEC) publishedon Saturday said that the vessel came within just 5.5 nautical miles of landfall off Akutan before it was rescued by mariners aboard the GRETCHEN DUNLAP and two other tugs.

The LAURA MAERSK arrived in Unalaska on Saturday morning where it was moored in Broad Bay at about 0745 local time.

A spokesperson for the DEC has said that the cause of loss of power aboard the containership is not known.

There were no reports of pollution or of injuries among the 24 members of the LAURA MAERSK crew.

The GRETCHEN DUNLAP was equipped with the State’s Emergency Towing System, the Coast Guard said.

After one tug arrested the containership’s drift approximately 5.5 nautical miles from landfall in Akutan, the crew of the GRETCHEN DUNLAP successfully deployed the State’s Emergency Towing System and towed the LAURA MAERSK to Unalaska.

As of Monday the LAURA MAERSK was still moored in Broad Bay and was awaiting repairs and an inspection from its classification society.

The tractor tug GRETCHEN DUNLAP was launched on Dec. 16, 2015, at Hansen Boat Company in Everett, Wash.

It is deployed by Dunlap Towing Company in Dutch Harbor, Alaska, where it assists ships calling at the port.

Dunlap provides towing and assist services throughout Puget Sound, along the Pacific Coast into Canada, to Alaska including remote ports above the Arctic Circle, and across the Pacific Ocean to Hawaii and beyond.

The full House Committee on Appropriations has approved the Fiscal Year 2018 appropriations bill for the Department of Transportation.

Significantly, the legislation includes the full authorized $300 million for the Maritime Security Program for Fiscal Year 2018.

The committee approved the bill yesterday evening by a vote of 31-20, clearing the legislation for consideration by the House of Representatives.

The House of Representatives has approved legislation that would enhance the recapitalization of the Ready Reserve Force (RRF) component of the national defense reserve fleet.

The legislation (HR 2810–the National Defense Authorization Act for Fiscal Year 2018) was sent to the full House after being approved by the House Armed Services Committee.

It would enable the Department of Defense (DOD) to purchase up to five foreign-built vessels for the RRF, provided the vessels had participated in the Maritime Security Program.

If no such vessels were available, the Department could purchase up to five other foreign built vessels if such vessels were available at a reasonable cost.

The language stipulates that before a foreign-built vessel can be purchased for the RRF, the Maritime Administration and DOD must certify that no U.S.-built vessel suitable for national defense or military purposes is available.

Washington State Democratic Senators Patty Murray and Maria Cantwell have teamed up with Republican Representative Dave Reichert to introduce bipartisan, bicameral legislation to reform the outdated Harbor Maintenance Trust Fund (HMTF).

The Harbor Maintenance Trust Fund Reform Act of 2017 would make sure all of the money collected through the Harbor Maintenance Tax (HMT) each year is returned directly to ports in order to improve infrastructure and keep ports competitive.

Currently, the HMT is not collected or spent in a way that ensures ports can continue to compete on a level playing field.

Some ports, including the Ports of Seattle, Tacoma, Los Angeles, and Long Beach, receive just pennies for each dollar contributed to the HMTF from cargo unloaded at their ports.

As so-called “donor ports,” they don’t receive the necessary investments they need to remain competitive.

In recent years, U.S. ports have seen ports outside the country target and capture U.S.-bound cargo in part because of the cost advantage of not charging the HMT.

The new legislation would address these inequities, enhance economic competiveness, and support jobs in Washington state and around the United States by ensuring donor ports can access funding for port infrastructure and rebates to shippers transporting cargo through their ports rather than routing cargo through Canada or Mexico to this country.

“For more than a decade, a number of U.S. ports have been operating at a competitive disadvantage, which is a drag on our economy and on thousands of good-paying jobs,” said Sen. Murray.

“The bipartisan bill we are introducing would be a critical step toward restoring investments in our ports, jobs, and economic development in Washington state and around the country.”

“As one of the most trade-dependent states, strong ports are critical to Washington’s local economy,” said Rep. Reichert.

“For too long, our ports have been put at a disadvantage–contributing much more than their fair share to the Harbor Maintenance Trust Fund and facing the loss of cargo to foreign ports because of the Harbor Maintenance Tax. By increasing funding to these ports including for rebates to shippers, the Harbor Maintenance Trust Fund Reform Act will help level the playing field supporting jobs and communities in Washington.”

“Washington state’s maritime industry supports 146,000 jobs and generates $30 billion in economic activity. By reforming the Harbor Maintenance Trust Fund, we can put Washington ports on a level playing field with their international competitors. It’s critical we continue to make investments in ports of all sizes so they have the tools and resources needed to create jobs and move Washington products around the globe,” said Sen. Cantwell.

Other House cosponsors of the bill include: Reps. Adam Smith (Wash.), Rick Larsen (Wash.), Suzan DelBene (Wash.), Denny Heck (Wash.), Derek Kilmer (Wash.), Pramila Jayapal (Wash.), Nanette Barragán (Calif.), Grace Napolitano (Calif.) and Alan Lowenthal (Calif.).

Working people in Brazil are protesting a controversial law—championed by the country’s highly unpopular president–that would weaken job market protections and sharply curtail the power of labor unions.

Brazil’s Senate passed the legislation last week in a tumultuous, day-long session marked by shoving, screaming and a six-hour sit-in organized by opposition leaders.

The lower house vote in April to approve the legislation sparked a 24-hour general strike that shut down much of the country.

The law will eliminate all restrictions on job outsourcing and end labor law requirements regarding vacations, overtime pay and hours of work.

It will also eliminate the fees that are the principal revenue source for Brazil’s labor unions.

The government has promoted the measure as “labor law reform.”

It is part of a program that the country’s president, Michel Temer, says will get the economy going again.

Working people and their unions say that it will mean lay-offs and the end of the employment agreements that protect their rights on the job.

The International Labor Organization (ILO) says provisions of the law violate international labor conventions.

“The problem starts with the name, which is deceptive,” says one Brazilian union official.

“‘Reform’ gives the impression that it is a good thing, but in reality it will serve only the interests of multinational corporations and their CEOs.”

Opposition party senators tried to block the vote on the bill with a sit-in at the Senate president’s rostrum, but the session resumed after a six-hour delay and lawmakers passed the legislation by a vote of 50-26 on July 11.

The spectacle underscored how acrimonious Brazilian politics have become in recent months as the president’s popularity has plummeted and a corruption charge against him has emboldened members of the opposition who believe he should never have become president.

Temer was indicted in June by the independent public prosecutors’ office for graft and other crimes.

He took power last year after his predecessor, Dilma Rousseff, was impeached and removed from office.

The annual Women on the Water (WOW) Conference will be held this year at the Great Lakes Maritime Academy (GLMA) in Traverse City, Mich., Oct. 26-28.

WOW is supported by the Maritime Administration. It brings cadets from the state maritime academies and the U.S. Merchant Marine Academy together with leaders in various sectors of the maritime industry.

The goal is to allow the cadets to learn about maritime careers directly from industry professionals.

The conference addresses current issues and provides industry contacts while helping cadets develop strategies for success going forward.
