Congress should reaffirm its support for essential maritime programs and find ways to expand the U.S.-flag fleet and grow the ranks of American mariners, maritime unions told members of the House Subcommittee on Coast Guard and Maritime Transportation in testimony last week.

Bill Van Loo, secretary-treasurer of the Marine Engineers’ Beneficial Association (MEBA), presented joint testimony at the hearing on behalf of MM&P, MEBA, the American Maritime Officers and the Seafarers International Union.

“To remain available in times of war and to support our Nation’s economic security, the U.S.-flag Merchant Marine must be supported during times of peace,” he testified.

The subcommittee convened on Jan. 17, under the chairmanship of Rep. Duncan Hunter (R-Calif.), to hear eight witnesses, including Van Loo, present testimony on “the State of the U.S.-Flag Maritime Industry.”

Hunter said in his opening remarks that there are now only 82 U.S.-flag vessels active in international commerce, down from 850 vessels 35 years ago.

He also noted that the active pool of U.S. merchant mariners is decreasing due to retirements and low recruitment rates.

In his testimony on behalf of maritime labor, Van Loo called for a “coordinated approach to a national maritime policy that starts with ensuring a steady stream of cargo.”

“It is very simple,” Van Loo said. “Without cargo, our ships do not sail and our mariners do not stand by.”

“Cargo is king,” said Maritime Administrator Mark Buzby, who also testified at the hearing.

He explained that cargo determines “the number of ships in the U.S.-flagged fleet, and the number of ships then influences the number of mariners who are available to run those ships and maintain a strong, resilient, U.S. Merchant Marine.”

In their joint testimony, the maritime unions advocated new bilateral shipping agreements to provide U.S.-flag vessels with a greater share of America’s foreign trade.

Only 2 percent of global U.S. trade is now carried on U.S. bottoms.

The unions are also calling for renewal of the U.S. Merchant Marine to be part of the infrastructure legislation now said to be under development by the Trump administration.

Among the other witnesses at the hearing were New Jersey Sandy Hook Pilots President Andrew McGovern and Matt Woodruff, president of the American Maritime Partnership.

The Coast Guard has issued an advisory stating that the Department of Transportation (DOT) Drug Testing requirements have been changed to include semi-synthetic opiates.

DOT has amended the drug-testing program to add hydrocodone, hydromorphone, oxymorphone and oxycodone to the “Opioids” section of the drug-testing panel.

The agency said that in addition to the previous DOT drug testing panel that tests for marijuana, cocaine, amphetamines, phencyclidine (PCP) and opiates, mariners in safety-sensitive positions will also be tested for the four additional semi-synthetic opioids named above.

It said common names for these semi-synthetic opioids include OxyContin, Percodan, Percocet, Vicodin, Lortab, Norco, Dilaudid and Exalgo.

“If a mariner tests positive for any of the semi-synthetic opioid drugs after Dec. 31, 2017, then as with any other drug test result that is confirmed by the laboratory, the Medical Review Officer (MRO) will conduct an interview with the mariner to determine if there is a legitimate medical explanation for the result. If the mariner has a valid prescription, it must be provided to the MRO, who will then determine if the prescription is valid. If a legitimate medical explanation is established, the MRO will report the result to the marine employer as a negative. If not, the MRO will report the result as positive.”

“When a marine employer or sponsoring organization receives a positive drug test result from an MRO, the marine employer or sponsoring organization is required to remove the mariner from performing regulated safety-sensitive duties and provide a list of qualified Substance Abuse Professionals to the mariner.”

“In accordance with 46 CFR 16.201(c), marine employers and sponsoring organizations are required to report positive test results of credentialed mariners to the U.S. Coast Guard.”

The agency advises mariners who may be taking such medications to consult with their prescribing physician to discuss their safety-sensitive responsibilities in order to determine if continued use is appropriate.

The authorities have issued advisories on the dangers to ships and mariners resulting from regional conflicts and the threat of piracy in a number of regions.

One advisory warns that as combat between Houthi rebels and the Saudi-led coalition continues, there are direct and collateral risks to U.S.-flagged commercial vessels operating in the Red Sea, Bab al Mandeb and the Gulf of Aden.

It says U.S.-flag vessels should “avoid entering or loitering near Yemen’s Red Sea ports,” adding that “vessels at anchor, operating in restricted maneuvering environments or proceeding at slow speeds should be especially vigilant.”

A separate advisory warns of piracy in the Red Sea, the Gulf of Aden, the Arabian Sea, the Indian Ocean and the Gulf of Oman.

It reports two incidences of pirates being sighted in the Southern Red Sea in the past two weeks.

U.S.-flagged commercial vessels operating within the High Risk Area, as defined in U.S. Coast Guard MARSEC Directive 104-6, are required to comply with this MARSEC Directive due to the high risk of piracy, kidnapping, hijacking and armed robbery while operating in the region.

Vessels are further advised to navigate at least 200 nautical miles off the Somali coast to the extent practicable.

The National Labor Relations Board (NLRB), now with a Republican majority under President Trump, is asking the public to weigh in on whether to rescind an Obama-era rule that speeds up union elections.

The rule the board is seeking to rescind limits the tactics employers can use to delay elections after employees at a workplace collect enough signatures to form a union.

The Obama-era change was an attempt to curtail maneuvering by employers, who often succeed in stalling union elections for months or years and use the intervening period to intimidate employees.

Business groups like the U.S. Chamber of Commerce have been pushing the NLRB to roll back the rule since it was passed by the Obama board in 2011.

The public is now being asked to submit comments by Feb. 12 on whether the rule should be kept as it, amended or rescinded.

The NLRB is the government agency charged with protecting workers’ rights and limiting industrial conflicts.

It provides protections to 77 percent of all private sector workers in the United States, both unionized and nonunionized.

Maritime Administrator Mark Buzby discusses the challenges facing our industry in the most recent edition of a new podcast that focuses exclusively on maritime.

The podcast is hosted by MM&P Vice President Gulf Ports-Government Affairs Klaus Luhta and is available on iTunes.

In the most recent edition, “A Leader’s Leader,” Adm. Mark Buzby talks about the current state of the American maritime industry and the challenges ahead.

“Admiral Buzz, as he is affectionately called, has prepared all his life for this job,” Luhta says.

“His philosophy is to take care of your people first. Give them the tools they need to do the job. Then get out of the way.”

As head of the Maritime Administration, Buzby advises and assists Secretary of Transportation Elaine Chao on commercial maritime matters, the U.S. maritime industry and strategic sealift.

He also maintains liaison with public and private organizations involved in the U.S. maritime industry.

In the interview, he discusses some of the challenges facing our industry and how he plans to address them

Union membership has been declining in the United States for decades: about 12 percent of American workers were union members in 2017, down from 19 percent in 1987.

There was, however, some good news in the Jan. 19 Bureau of Labor Statistics (BLS) annual report on union membership.

Rather than a decline, it found that the number of union members in the country increased by 260,000 in 2017.

There were successful union drives last year in a number of industries.

One group pushing particularly hard for union representation: federal government employees.

With Republicans in charge of both houses of Congress and the White House, membership in federal unions is on the rise, a trend that is being fueled by fears of reductions in pay and benefits, budget cuts, layoffs, furloughs, sequestration and the like.

The biggest federal employee union, the American Federation of Government Employees, reported 5,000 new members in the first three quarters of 2017.

Another public sector union, the National Federation of Federal Employees, reported in November that it was on track to register 7 percent membership growth in 2017.

Other trends that emerge from the BLS statistics and news reports:

— journalists and online media staff are flocking to unions, a reflection of the tensions the industry is experiencing and their impact on wages and working conditions;

— thousands of workers are unionizing in states like South Carolina, Michigan and Wisconsin, where “right-to-work” laws aimed at eliminating unions have been passed in recent years;

— young workers, defined as people under the age of 35, made up three quarters of new union members last year.

Charter school teachers, information sector professionals, adjunct professors and librarians are among those who joined unions last year.

And more than 20,000 doctors in the United States also formed new unions.

“In the face of a challenging year, the power of working people is on the rise,” said AFL-CIO President Richard Trumka.

“Together, we organized historic new unions, stood up to powerful corporations, and won higher wages.”

MM&P members who work for the City of Chicago have ratified a new five-year collective bargaining agreement, reports MM&P Great Lakes & Gulf Vice President Tom Bell.

Members of the group work for the Chicago Water Department and the Chicago Fire Department.

They operate the TUG VERLUIS, which helps keep the waterways of the city navigable and safe, and the CHRISTOPHER WHEATLEY, a fireboat that can also break ice.

On a frosty winter night, nothing beats a really decadent mug of hot chocolate.

This works equally well if you live somewhere where January temps are an unseasonable 70+ degrees (Trust the folks at Labor411—they’ve tried it).

The hot chocolate recipe below is one of their favorites, and by using ingredients from companies that treat their workers fairly, you can also take pride in being an ethical consumer.

Winter-Busting Hot Chocolate

3 tablespoons cocoa powder, plus more for serving (Ghirardelli)

3 cups whole milk (Horizon, Hiland, Alta Dena)

6 ounces of semisweet chocolate (Ghirardelli, Hershey), finely chopped

3 tablespoons demerara or granulated sugar (Domino)

Lightly sweetened whipped cream (for serving) (Horizon, Hiland, Alta Dena)

Bring ¾ cup water to a simmer in a medium saucepan over medium-high heat. Whisk in 3 Tbsp. cocoa powder until no lumps remain, then add milk and return to a simmer. Whisk in chocolate and sugar and cook, whisking frequently, until mixture is smooth and creamy and chocolate is melted, about 5 minutes.

Divide hot chocolate among mugs. Top with whipped cream and dust with cocoa powder.

Maersk and computer giant IBM have announced they will form a joint venture based on “blockchain” technology to provide more efficient and secure methods for conducting global trade.

Blockchain has been described by experts as a distributed, digital ledger that can be shared with other parties around the world without passing through a central intermediary.

Proponents say it can dramatically reduce transaction and other costs, while minimizing or even eliminating the risk of tampering.

The companies said in a joint statement that Michael White, former president of Maersk Line in the United States, will lead the new company, which will be headquartered in New York.

“This new company marks a milestone in our strategic efforts to drive the digitization of global trade,” said Maersk Line Chief Commercial Officer Vincent Clerc, who will chair the new company.

“The potential in offering a neutral, open digital platform for safe and easy ways of exchanging information is huge. All players across the supply chain stand to benefit.”

Maersk and IBM say they began a collaboration in June 2016 to build new blockchain and cloud-based technologies.

Since then, the platform has been piloted by organizations including Port Houston, Rotterdam Port Community System Portbase, the Customs Administration of the Netherlands and U.S. Customs and Border Protection.

The two companies say their joint venture will allow them to sell their solutions to a larger market, including APM Terminals and PSA International, which plan to use the platform to improve terminal planning.

“Today, a vast amount of resources is wasted due to inefficient and error-prone manual processes,” White said.

“The pilot projects confirmed our expectations that, across the industry, there is considerable demand for efficiency gains and opportunities coming from streamlining and standardizing information flows using digital solutions.”

The companies expect to be offering services within six months, after the new venture undergoes regulatory clearance.
