U.S.-FLAG MARITIME INDUSTRY SALUTES MASTERS, MATES & PILOTS; AWARDS TO PRESIDENT DON MARCUS, MM&P-CREWED SHIPS

MM&P President Don Marcus received the Admiral of the Ocean Sea (AOTOS) award–the U.S.-flag fleet’s honor for lifetime achievement–at an Oct. 28 ceremony sponsored by the United Seamen’s Service (USS).

The licensed deck officers and crews of two MM&P-crewed ships, MAERSK KENTUCKY and USNS MERCY, were also recognized; the first for heroism, the second for public service.

“MM&P appreciates the recognition we are receiving for our proud and time-honored role in the U.S. Merchant Marine,” Marcus said. “This award properly belongs to the mariners who today, tonight, are doing their job at sea.”

In his acceptance speech, he thanked his family for their support and the mentors who helped him along the path to becoming first a licensed deck officer, then a union official.

He also spoke of the essential role played by MM&P and the other maritime unions in preserving the U.S.-flag fleet.

“Political action by MM&P and the other maritime trade unions is the reason that the U.S. flag is still flown aboard merchant ships on the high seas,” he said.

“I take great pride in having successfully served as a professional licensed deck officer,” he told the audience.

“My pride is magnified by the honor of serving as a union official for the men and women of Masters, Mates & Pilots. I may be biased, but there is no finer group of professionals at sea today.”

At the beginning of the awards ceremony, MM&P Captain William Imken accepted an award for heroism on behalf of the officers and crew of MAERSK KENTUCKY, who rescued 11 fishermen from a boat that was sinking in the middle of the Indian Ocean.

Officers and crew of the Military Sealift Command hospital ship USNS MERCY were recognized for their service during the five-month Pacific Partnership humanitarian mission in Timor Leste, the Philippines, Vietnam, Malaysia, Indonesia and Palau.

Also honored during the evening were Arthur E. Imperatore, founder and president of New York Waterway and Christopher Wiernicki, chairman and CEO of the American Bureau of Shipping.

THE COST-BENEFIT ANALYSIS FOR “AUTONOMOUS SHIPS” JUST DOESN’T PAN OUT

There has been a lot of talk recently about unmanned, “autonomous ships” representing the future of the maritime industry.

But can the additional costs of an autonomous system be offset by substantial reductions in or the elimination of crewing costs?

If not, there is no economic justification for ship owners to move to autonomous ships, writes MM&P Vice President George Quick in an article that is being circulated widely in the maritime trade press.

It is estimated that crewing costs are about 6 percent of the overall cost of running a ship. Capital costs are about 42 percent and voyage costs, including bunkers, run about 40 percent.

“There can be no doubt that shipping is capital intensive rather than labor intensive,” Quick writes.

He points out that the cost of building a ship with the required technology and redundancies for remotely controlled operation will probably be higher than that of a conventional ship–even if one factors in potential savings from the elimination of the crew’s accommodations.

An autonomous system would also require shore-side infrastructure with global reach for monitoring and control, as well as expensive shore-side support for maintenance, repairs and functions now carried out on conventional ships by seafarers from relatively low-cost-labor-supply countries.

Even if all manning were to be eliminated, Quick writes, it is not at all clear how a relatively minor savings in crewing expenses could compensate for the additional costs of building and operating a remotely controlled autonomous ship system and its supporting shore-side infrastructure.

Autonomous ships may become technically feasible, however, the bigger question is whether they will be commercially feasible with a comparable level of safety in most trades.

So far there has been a noticeable lack of enthusiasm for autonomous ships among ship owners, he notes. Perhaps they have a better grasp of the economics than the enthusiastic proponents?

The U.S Export-Import Bank (Ex-Im Bank) supports millions of U.S. jobs and helps businesses of all sizes compete in a global economy.

And 100 percent of all cargo financed by Ex-Im Bank transactions above $20 million must be carried on U.S.-flag vessels.

While a super-majority of Congress approved a multi-year reauthorization about a year ago, the bank is not fully back at work.

As a result of congressional inaction, the bank’s governing board is without a quorum and cannot approve loans of more than $10 million. As a result, businesses of all sizes in the United States–and their suppliers and workers–are still at a global disadvantage as foreign governments continue to use their own export credit agencies to support their exporters with generous export credit.

As a result, American companies are facing lost sales and jobs. Pennsylvania-based Mack Trucks cannot close two multimillion dollar sales. To continue serving customers and bid on existing projects, GE Power announced that it would move 500 jobs from Texas, South Carolina and Maine to France, Hungary and China, where it could continue offering customers ECA financing to purchase its products.

In all, more than 30 transactions valued at over $20 billion and affecting tens of thousands of U.S. jobs cannot be completed without a board quorum. All of the transactions that make up the $20 billion in backlog are subject to U.S.-flag shipping requirements.

Earlier this year, identical language was adopted in both the House and Senate State & Foreign Operations appropriations FY 2017 bills that would temporarily modify the bank’s quorum requirement so that it may again review transactions over $10 million dollars.

It is critical that Congress move forward with that language in the final spending bills to be completed during the lame duck session. Ask your representative and senator to support U.S. exporters and jobs in the United States by urging him or her to make the inclusion of this Ex-Im language a priority in the final spending package.

CANADA REVOKES KIRBY MARINE’S PILOTAGE WAIVER AFTER CATASTROPHIC OIL SPILL

Following the Oct. 13 oil spill in the protected waters of the Inner Passage, Canada has revoked waivers that allowed Texas-based Kirby Corporation to operate along the coast of British Columbia without a local pilot on board its tugs.

Meanwhile, people who live and work near the site of the Kirby spill off Bella Bella, British Columbia, are blasting the authorities’ response to the disaster.

The Kirby-owned tug NATHAN E. STEWART grounded and sank on Edge Reef in Seaforth Channel, off the remote central coast of British Columbia, as it was pushing a fuel barge.

The barge was empty but the tug was carrying 60,000 gallons of diesel, much of which was released into the water and spread along coastlines.

On Oct. 26, Canada’s Minister of Fisheries, Oceans and the Coast Guard released a statement saying that oil pumping from the tug had been completed and that the operation would shift to salvaging the articulated tug-barge unit.

“Nothing could be further from the truth,” responded the leader of Heiltsuk First Nation, the native tribe that depends on the waters for its livelihood.

“I’m infuriated by the minister’s seemingly good news statement that suggests that now that transfer of diesel from the tanks of the tug NATHAN E. STEWART is complete, we are basically turning our focus to pulling the dirty tug out of the water and sending it away,” said Heiltsuk Chief Councillor Marilyn Slett.

According to Slett, the authorities did not have anyone on the ground for close to a week after the spill and the Heiltsuk have been taking the lead on environmental assessments to determine spill impacts on local and commercial fisheries.

“There is no end in sight for the Heiltsuk people,” she said. “We’ve only started to scrape the surface to find out the extent of the damage done by the spill.”

The authorities have said they will review and approve Kirby’s plans to remove the tug, and that they have revoked a waiver that allowed Kirby tugs to operate locally without a pilot on board.

“The exemption that allowed the tug NATHAN E. STEWART and barge to operate in the Seaforth Channel without a pilot from the Pacific Pilotage Authority onboard has been revoked,” the government said in an official statement, adding that “such exemptions have been revoked for all vessels operated by the company.”

The area in which the accident took place is part of the Voluntary Tanker Exclusion Zone, but the NATHAN E. STEWART was not large enough to be covered under restrictions in place for the Inner Passage.

Kirby moves bulk liquid products throughout the Mississippi River System, on the Gulf Intracoastal Waterway, along all three U.S. coasts, and in Alaska and Hawaii.

The company recently agreed to pay $4.9 million in civil penalties to settle claims related to a March 2014 oil spill in the Houston Ship Channel. About 160 miles of shoreline were oiled as a result of that spill, which totaled approximately 168,000 gallons.

GLOBAL UNION ORGANIZATIONS WELCOME RULING ON UBER DRIVERS IN THE UNITED KINGDOM

The International Trade Union Confederation (ITUC) and the International Transport Workers’ Federation (ITF) have welcomed a ruling that Uber drivers in the United Kingdom are workers rather than self-employed freelancers and deserve basic workers’ rights: a guaranteed minimum wage, breaks, paid holidays and whistleblower protection.

The landmark ruling was delivered by the London Employment Tribunal on Oct. 28 in a case brought by GMB, a member union of ITF and ITUC.

The court found that Uber drivers in the United Kingdom–30,000 of whom work in London–are workers within the meaning of the Employment Rights Act 1996 and therefore entitled to basic employment rights. Uber said it would appeal the ruling.

The case is the latest successful union-led challenge to Uber’s claims that its drivers are self-employed contractors, and follows similar cases in Copenhagen, Buenos Aires and New York.

“Polling shows that 82 percent of people want workers employed by companies like Uber to have the same basic rights and entitlements as other employees. Uber’s workers have the weight of public opinion on their side, and its UK workforce now has the protection of the law,” said ITUC General Secretary Sharan Burrow.

Uber is expected to undertake a massive publicity, legal and lobbying effort to overturn the ruling.

The United Nations’ women’s arm, UN Women, last year called off a proposed partnership with Uber following a storm of criticism about the company’s precarious, low-wage employment model.

“Workers in so-called ‘gig’ economy companies across the world are demanding their rights, with unions helping them to organize and take on the legal and political battles for decent incomes and working conditions,” Burrow added.

“And governments need to take a close look at the tax affairs of these companies too, as well as how they use the huge amounts of data they harvest from consumers and their employees.”

“This judgment tears away the mask of driver independence that Uber has so assiduously cultivated,” said ITF President Paddy Crumlin.

“In Copenhagen, New York, London, Paris, Brussels and beyond–with more cases certain to come–the challenges are being heard and the courts are making clear that workers deserve workers’ rights.”

“What the travelling public want and deserve are safe, regulated taxi services, whose drivers have the basic rights and protections that make them fit to take to the road,” said ITF General-Secretary Steven Cotton.

“The use of taxi booking apps has been undermining this goal, raising worrying questions of exploitation, deregulation and non-payment of tax. This latest ruling is a significant step forward to forcing these new employers to face up to their responsibilities to their workers and the general public.”

Uber has faced a string of lawsuits from its drivers across the world. Drivers in the United States have launched a class action lawsuit, accusing Uber of misclassifying them as contractors when they’re actually treated as employees.

Lawyers for California and Massachusetts drivers in the case reached a tentative $100 million settlement earlier this year that would not change drivers’ statuses, but would add certain protections and allow them to solicit tips.

JORGE VISO ELECTED PRESIDENT OF THE AMERICAN PILOTS’ ASSOCIATION

Jorge Viso of the Tampa Bay Pilots was elected president of the American Pilots’ Association at the APA’s 2016 Biennial Convention last week.

“APA-member pilots play a vital role in ensuring the safe, efficient and environmentally friendly movement of maritime commerce in this country,” said Viso, who will begin serving his four-year term on Jan. 1.

“I am tremendously honored that my peers and fellow professional maritime pilots around the country have placed their trust in me to lead our national association.”

He said he will work closely with partners in government and industry, as well as APA officers and staff, “to vigorously represent the interests of pilots and to advance the highest compulsory pilotage standards.”

Viso has served as a state-licensed pilot in Tampa Bay ports since 1990. He has long been involved in the leadership of the APA, having served as vice president for the South Atlantic States and chair of the APA Navigation and Technology Committee. He has also served as chair of the Tampa Bay Pilots’ Association and as president of the Florida State Pilots’ Association.

The end of the year is the deadline for STCW-Gap Closing Training Requirements: in less than two months, the requirements go into force.

There are mandatory training requirements for operational and management deck/engine officers.

Unless the training has been completed, deck and engine officers will not be able to sail on their STCW credential after Dec. 31.
